OSHA Local Emphasis Program to Focus on Automotive Services

ADAND members should be aware that OSHA has implemented a local emphasis program (LEP) to identify and reduce or eliminate the workplace incidence of health and physical hazards associated with automotive services. North Dakota dealers may be scheduled for an OSHA inspection. These inspections will be conducted to determine if safe work practices and procedures have been implemented for the employees in the workplace. Enforcement inspections initiated under this program will begin after January 1, 2017, however inspections could be initiated prior to that date as a result of a complaint or referral related to an incident.

The U. S. Citizenship and Immigration Services has revised its Employment Eligibility Verification Form I-9 to reduce potential errors and enhance digital completion. Effective January 22, 2017, employers must use only the new Form I-9, which is dated Nov. 14, 2016. Enacted into law in 1986, the Immigration Reform and Control Act (IRCA) prohibits employers from hiring people for employment in the United States without first verifying their identity and employment authorization using Form I-9. Changes to Federal Overtime Rule Blocked

A U.S. District Court in Texas has granted a nationwide preliminary injunction against implementation and enforcement of the revised "white collar" overtime rules formally scheduled to take effect on December 1, 2016. This means that, until further notice, the existing "white collar" salary thresholds remain in effect and that dealers should not make employee compensation adjustments based on the revised "white collar" rule's higher compensation thresholds. The lawsuit challenging the rule was filed by twenty-one states and a variety of business groups. A motion for summary judgment is expected. Additional information will be provided as further details are received.

Jesse Peterson Elected ADAND Chairman

Jesse Peterson, Bismarck, ND, was elected Chairman of the Automobile Dealers Association of North Dakota (ADAND) during our organization’s annual conference held recently in Fargo. Jesse is a partner in Eide Ford Lincoln in Bismarck, Eide Hyundai in Grand Forks, and Eide Chrysler Dodge Ram Jeep in Pine City, Minnesota. He has served on the ADAND Board of Directors since 2010. Christian Kostelecky, Dickinson, ND, became ADAND's Chairman-Elect. He is the Dealer Principal of Sax Motor Co., a Chevrolet, Cadillac, and Chevrolet Business Elite dealership in Dickinson, and has served on the ADAND Board since 2011.
